Police chargesheet under pornography law on behalf of 4 accused in Rangamati after one year: Plaintiff expresses anger

--- Nirmol Barua Milon :: After the one year of submission of a case filed against five accused under the Digital Security Act for the accusation of harassment of a woman from BarkalUpazilla, Rangamati Hill Tracts, a chargesheet reports was s being submitted by the Investigation officer (IO) to the Court. Releasing four of the five and making one of them as accused (Nakul Chandra Sharma) a chargesheet was being submitted to the court.
Though it is mandatory to submit the charge sheet within the 90 days for the case filed under the Digital Security Act/Pornography Control Act, but after 350 days of submission of the case file it was submitted to the court.

The victim and the PlaintiffRakhiKhisa filed the case in 22 June 2020 against the five personwho were being accused of embezzlementthrough deception and capturing of offensive videos and publishing them on social media. The accused in this case were: 1. Nokul Chandra Sharma, Father: Late. Sudhon Chandra Sharma, Vil: Horina Bazar Area, 2. Md. SohelRana, and 3. Md. SumonParvez, Father of both of them (2 and 3):Abdul malek, Vil: Horina Bazar Area (Amtola), 4. Md. YousufRana, Father:Late. OliAhmmad, Vil: Horina Bazar Area (Amtola), Thana: Barkal, Upazilla: Barkal and 5. Amar Shanti Chakma, Father: CironjibChakma, Mother: IndradeviChakma, Vil: Kusumchari, Suvolong, Present Address: Vil: Dhonubagh Master para, (SurherHasi Clinic ChotoHarina Branch), Thana: Barkal, Upazilla: Barkal, District: Rangamati Hill Tracts.
The victim submitted the case file in Barkal Thana FIR no: 01 date: 22 June-2020, and Case no. of RangamatiCognizance Court: 209/2020.
Last 27 December 2020 Chittagong Police Bureau of Investigation (PBI) members arrested accused Nakul Chandra Sharma (31) from Sanjit Saloon in Mazzartek area of Karnafuli police station. Then the PBI officers brought him to PBI Office, South Khulshi of Chittagong and interrogated him. After the confirmation of information of the accused, the investigating officer of PBI handed him over the IO of this case Md. Kamal Hossain, sub-inspector, Barkal police. The next day 28 December 2020, through the court of Rangamati Chief Judicial Magistrate Asad Uddin Asif he was sent to jail. Remand has been granted for 2 days for further interrogation of the case by the Judicial Magistrate Belal Hossain, in last 6 January, 2021, Wednesday, after the hearing of the IO through the virtual court.

The number one accused of this case Nakul Chandra Sharma has been lodged in Rangamati District Jail since December 28, 2020.

Then the PBI officers brought him to PBI Office, South Khulshi of Chittagong and interrogated him. The plaintiff in the case expressing anger said that the investigating officer of Barkal police station had removed the names of the four accused from the charge sheet because these accused have a secret relationship with the police officers. She also mentioned the police did not even interrogate these four accused. She also complained that IO filed a complaint under the Pornography Control Act but did not file a complaint of embezzling of 70,000 taka to the court.

The plaintiff said, “The law is equal for all. I want all criminals to be punished through impartial investigation. Police have been biased in investigating the case and have filed inconsistent charges in court.” She also said she will apply to seek a full investigation into the case through her lawyer.
